Please read carefully this Agreement before using the Card. This information represents the terms and conditions of the Card. By using the Card, you accept these terms and conditions. If you do not understand or do not approve a clause, you should discuss it with the representatives of the public institution that granted you the Card or you should contact the representatives of the Customer Support Department, by using the contact details from art. 16.

1. DEFINITIONS

"Account" shall mean the electronic account associated with the Card

"Agreement" shall mean this agreement as amended from time to time;

“Available balance” shall mean the value of the social voucher for hot meals, loaded on the Card and that can be used according to the Romanian legislation on electronic social vouchers for hot meals;

“Card” shall mean the Mastercard® Edenred® Social card for hot meals, issued to you under this Agreement;

"Card Number" shall mean the 16-digit card number found on the Card recto;

“Carrier letter” shall mean the letter accompanying the Card;

"Contactless" (without contact) shall mean a payment characteristic offering you the possibility to pay by accessing your Card through a compatible NFC terminal (”Contactless Terminal”). The Contactless transactions shall be subject to the limits applied by the Merchant and/or Contactless Terminal. For those Transactions exceeding any such limits, you shall be required to authorize the Transaction by other means (see paragraph 4.3).

“Contracting Authority” shall mean the Ministry of European Investments and Projects, which is the purchaser of the Edenred® Social cards for hot meals;

"Customer Service" shall mean the contact center for resolving any queries and service requests in relation to the Card. The contact data for the Customer Service can be found in Art. 16 and on the Card verso;

"CVC" shall mean the Card Verification Code associated with the Card. It shall be found on the Card verso;

"Edenred" (or we) shall mean Edenred Romania SRL, the authorized issuer of the lunch vouchers stored on the Card, a company registered in Romania under number J40/5659/1998, sole registration code RO10696741, with its registered headquarters in Calea Serban Voda No.133, Sector 4, Bucharest, Romania;

"Full Deductible Amount" shall mean the full Transaction amount.

PIN refers to the personal identification number made up of four digits, that will be used with the Card;

"Mastercard®" shall mean Mastercard International Incorporated, with its registered headquarters in 2000 Purchase Street, Purchase, New York 10577 USA;

"Mastercard Acceptance Mark" shall mean the Mastercard International Incorporated signage indicating the acceptance of Mastercard cards;

“Merchant” shall mean any economic operator, part of the Edenred® Social for hot meals programme, displaying the Edenred logo and the Mastercard Acceptance Mark;

“My Edenred” shall mean the online platform and mobile app, available for Android and iOS, through which Edenred offers you details regarding the Card balance, the Transaction history, Card top ups, amounts about to expire, PIN reminders, Card blocking, 24 hours a day, 7 days a week, 365 days a year.

"PIN" shall mean shall mean the four-digit personal identification number which should be used together with the Card;

“PPT” shall mean the card issuer, PrePay Technologies Limited, a company registered in England and Wales under number 04008083, which can be contacted at PO BOX 3883, Swindon, SN3 9EA.

"POS Terminal” shall mean an electronic device facilitating card payments at the merchant’s sales points;

“Programme” or ‘Edenred® Social for hot meals’ refers to the electronic social voucher programme for hot meals, under which your Card is issued;

"Strong Customer Authentication" means additional security measures to verify that you have authorized certain Transactions or other actions related the use of your Card and/or Account;

“Transaction” shall mean any Card transaction carried out through a POS Terminal.

“Website” shall mean the www.edenred.ro website, which allows you to access the information related to the Card and contains a copy of the terms and conditions of the Card.

“You” (Your) refers to yourself, the Card Holder considered eligible by the Contracting Authority to use the Card;

2. THIS AGREEMENT

2.1. This Card was issued by PPT under the license granted by Mastercard International. The card remains the property of PPT.

2.2. The Edenred® Social for hot meals is managed by Edenred România SRL, the issuer of electronic social vouchers for hot meals. The card is valid only in Romania, within the network of merchants accepting the Edenred® Social card for hot meals, displaying the Edenred logo and the Mastercard Acceptance Mark. The programme is subject to specific legal regulations. Limitations imposed by regulations and by any changes thereof may impact the features and functionality of your Card.

2.3. The value associated with your Card is expressed in RON.

2.4. Your card is a prepaid card that contains electronic social vouchers for hot meals. This is not a credit, expense or debit card.

3. RECEIVING AND ACTIVATING THE CARD

3.1. The Edenred Social card for hot meals is already active and can be used from the moment it comes into your possession.

3.2. The PIN code is necessary for transactions exceeding a certain amount at partner merchants and has been provided along with your card. You must keep your PIN confidential at all times and you must not disclose it to any person, and you must not enter your PIN code in a way that would give other people the chance to easily see it. We will not disclose your PIN code to any third party. If you forget your PIN code, it can be reminded to you by calling 021 301 33 03 (normal rates apply).

4. USING THE CARD

4.1. The Card can only be used in Romania to make Transactions in RON, in accordance with and within the limits provided by the legislation in force in Romania on electronic hot meal social vouchers.

4.2. The Card can be used at the Merchants within the Edenred Social cards for hot meals network displaying the Edenred mark and the Mastercard Acceptance Mark, in order to fully or partially pay for a hot meal. At the Contracting Authority’s request, the Card has a daily usage limit of 40 RON.

4.3. You will have to authorise every Transaction through one of the methods below. You will be liable for all the Transactions that you authorise:

  • 4.3.1. entering the PIN code;
  • 4.3.2. signature of receipt;
  • 4.3.3. using the Card at a Contactless Terminal, right from the first Transaction; You can make 5 consecutive Contactless transactions after which any Contactless transactions will be declined and you will be required to enter your PIN to authorize the Transaction.
  • 4.3.4. providing information regarding the Card and/or providing any other detail necessary for the completion of a Transaction.

4.4. Usually, you cannot stop a Transaction after you have authorised it from the moment it is deemed to have been received by PPT.

4.5. The Card cannot be used to purchase non-food products, including cigarettes and alcohol.

4.6. The Card is a prepaid card containing the value of social vouchers for hot meals, which means that the Available Balance on the Card will be reduced by the Full Deductible Amount on the ‘first in, first out’ principle. To authorise a Transaction, the Full Deductible Amount must be smaller than or equal to the Available Balance of funds for hot meal social vouchers on your Card. You must not use the Card if the Full Deductible Amount exceeds the Available Balance of funds for hot meal social vouchers or after the Card expiry date. If, for any reason, a Transaction is processed for an amount larger than the Available Balance of funds for hot meal social vouchers on the Card, you must reimburse us the value with which the Full Deductible Amount is exceeding the Available Balance, as appropriate, either within 30 days from receiving an invoice from us, or by our withholding the difference at the following Card top up. If you fail to reimburse this amount, we are entitled to take all the necessary measures, including legal action to recover any amounts due.

4.7. You can check the Available Balance at any time in Your account, from MyEdenred account or by calling 021 301 33 03.

4.8. There are certain circumstances when Merchants may ask for an Available Balance larger than the value of the Transaction. However, you will be charged the actual and final value of the Transaction.

4.9. The Card cannot be used for cash withdrawals.

4.10. The Available Balance in the Account cannot accrue any interest.

4A. USING 3D SECURE

4A.1. 3D Secure is a payment authentication standard for internet purchases which adds an extra layer of security when purchasing goods or services online with participating retailers. It is a form of Strong Customer Authentication. To enhance the safety of online payments, you will increasingly need to use 3D Secure to confirm it’s you when you make payments online.

4A.2. To use 3D Secure:

  • you must have internet access;
  • you must have a mobile phone;
  • we must have your correct mobile phone number; 
  • your mobile phone must be able to receive text messages;
  • your mobile phone must have the MyEdenred App installed. 

It is important that you ensure that the personal information we hold for you (in particular your mobile phone number) is up-to-date. You can do this via MyEdenred App.

4A.3. When making a purchase online for which authentication is required, you will be brought to a 3D Secure verification screen.

4A.4. You’ll be prompted to enter a one-time passcode (passcode) sent to your mobile phone by text message (SMS) to complete your purchase. Alternatively, you may be asked to verify yourself using the MyEdenred App. You have a set amount of time and a number of attempts to enter the passcode correctly. If you do not enter the passcode correctly, you will be unable to complete your online purchase.

4A.5. The passcode will only be valid for the online purchase you have received it for.

4A.6. We will deem any transaction authenticated using 3D Secure as having been authorised by you.

4A.7. We do not charge for 3D Secure. You are responsible for any SMS fees charged to you by your mobile phone provider.

5. CARD TOP UP

5.1. You cannot top up the Card. The Available Balance of your Card will be topped up with additional funds if you remain eligible according to the requirements of the Contracting Authority and according to the contract we concluded with the Contracting Authority, at the date we receive instructions and payment from the Contracting Authority of the value of hot meal social vouchers corresponding to Your Account.

5.2. Please note that the funds shall expire in accordance with the legal regulations from Romania regarding hot meal social vouchers, namely within 12 months from the date of the Card top up and that, after such date, the respective funds can no longer be used.

6. CARD EXPIRY

6.1. The Card expiry date is printed on the front side of the Card. You will not be able to use the Card after its expiry and no Transaction will be processed.

7. YOUR LIABILITY

7.1. We may restrict or refuse the authorisation of any Card usage if the Card usage causes or may cause a breach of this Agreement or if we have reasonable grounds to suspect that either you or a third party have committed or are about to commit a crime or other abuse in connection with the Card.

7.2. If it is necessary to investigate a Card Transaction, you must cooperate with us or with any authorised body, as appropriate.

7.3. You must never allow any other person to use your Card. Selling your Card or giving it to another person to use it is forbidden.

7.4. You will be liable for all the Transactions that you authorise in accordance with paragraph 4.3.

7.5. You must indemnify us and PPT for any breach of these terms and conditions, for any fraudulent use of the Card or for any legal action taken to enforce this Agreement.

8. CARD LOSS, THEFT OR DESTRUCTION

8.1. In case of loss, theft, fraud or any other risk of unauthorised use of the Card or if the said Card is deteriorated or does not work properly, you must contact the Customer Support Department immediately. You will be liable for any unauthorised Transactions that take place before you notify us, and these will reduce the Available Balance of the Card.

8.2. Provided that you notify us in accordance with paragraph 8.1 and provided that paragraph 8.3 does not apply, you will not be liable for any loss that occurs after the notification date. If an Available Balance is left on the Card, you may request, exclusively through the Contracting Authority, to replace the old Card with a new one and to transfer the last Available Balance to the latter. The decision to replace the Card rests with the Contracting Authority.

8.3. If we have grounds to believe that the notified incident was caused by the fact that you breached this Agreement through your negligence, or if there is reasonable suspicion of inadequate or fraudulent behaviour, then you will be liable for all losses.

9. DISPUTES

9.1. If you have reasons to believe that a Transaction for which the Card was used was unauthorised or was carried out on your Account by mistake, you must contact the Customer Support Department by calling 021 301 33 03.

10. COMPLAINTS

10.1. Any complaints in relation to these terms and conditions must first be addressed to the Contacting Authority. Alternatively, you can call the Customer Support Department. The Complaint Procedure may be accessed at www.edenred.ro.

11. AMENDMENT

11.1. We can amend the terms and conditions of this Agreement at any moment, by posting an updated version on the Website.

11.2. If any part of this Agreement does not observe any regulatory requirements, we will not consider that part, and we will treat it as if it would actually reflect the relevant regulatory requirement.

11.3. We will reasonable notify the Contracting Authority of any change of rate or service levels included in these terms and conditions, and for this reason these terms and conditions will be posted on the Website and updated constantly. If you continue to use the Card after the said amendments have taken effect, it means you accept the obligation arising from the amendment to the terms and conditions.

12. TERMINATION OR SUSPENSION

12.1. If we are informed that you are no longer eligible to use the Card for any reason, then the Card will be blocked immediately and the Available Balance will no longer be usable.

12.2. This Agreement can be terminated or the Card may be suspended at any moment effective immediately (by the date of the settlement of the dispute or the termination of the Agreement) if you breach this Agreement or if we have any reason to believe that you used or you intend to use the Card negligently or for fraudulent purposes or for other illegal purposes or if PPT can no longer process your Transactions due to third party actions. Under these circumstances, no Available Balance will be usable.

13. OUR LIABILITY

13.1. We provide you with electronic hot meal social vouchers, exclusively intended for purchasing meals cooked from food products, prepared by thermal processing, according to this Agreement and according to the provisions of the Government Emergency Ordinance no. 115/2020, these being entirely granted on the expense of the Contracting Authority, within the Operational Programme for Helping Deprived People, funded from the The Fund for European Aid to the Most Deprived in Romania.

Our liability for the functionality of the Card and of the Programme is established through the contract we concluded with the Contracting Authority. If you have difficulty using the Card, please contact the Contracting Authority.

14. YOUR INFORMATION

14.1 We may and we will hold personal information about You, in accordance with all the applicable laws and regulations on the processing of Personal Data, including, but not limited to the Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and appealing the Directive 95/46/EC.

14.2 Your personal data (such as surname, name, personal identification code, home address, email account, details regarding the Transaction) may be necessary to have Card-related services provided to you and, as such, it can be processed for the following purposes: issuing and activating Cards, delivering Cards, topping up Cards with hot meal social vouchers, providing access to information (such as Transaction History, Available Balance), responding to requests, processing Transactions, performing the necessary fraud management and observing the regulatory requirements (including the applicable regulation on money laundering/countering terrorism financing).

14.3.For verification and security purposes, such as the application of Strong Customer Authentication measures, we are required to collect certain personal information from you including your mobile phone number. We will pass this data to our third-party service providers as required for the administration of Strong Customer Authentication measures.

14.4 Your personal data will not be processed for other purposes unless you give us your prior consent or we have another legal ground for such a processing.

14.5 Unless required by law, Your personal data will not be transmitted without your permission to any other person except the Contracting Authority, national authorities with monitoring, checking, control and audit duties, Edenred and the providers of necessary technical services, used for supplying services covered by this Agreement, including PPT.

14.6 Your personal data will not be transmitted outside the European Union or Great Britain, unless we obtain Your approval.

14.7 For further details on Your rights regarding the processing of personal data, please read the Privacy Policy available at www.edenred.ro.

14.8 For any additional queries regarding the manner in which the personal data is processed and in order to exercise the aforementioned rights, please complete the contact form available on our Website. You can also submit a customised request, signed and dated, containing the personal data you would like us to update or delete, to our addresses, in the attention of the personal data processing officer: The Edenred office in Bucharest, 133 Calea Şerban Vodă, 040205 - District 4, Bucharest.

14.9 Monitoring the observance of the legal requirements in this field is exclusively ensured by the data protection officer appointed at the level of the Edenred Group, with the following contact details: dpo.romania@edenred.com.

15. GENERAL PROVISIONS

15.1. If any provision of this Agreement is considered inapplicable or unlawful, the rest of the provisions remain in full force and effect.

15.2. Except otherwise provided, any third party that is not a party to this Agreement does not have the right to apply any of the provisions mentioned in these terms and conditions, except the fact that Mastercard International Incorporated and its affiliates may apply any provision from this Agreement that grants them rights or benefits.

15.3. This Agreement is governed by the Romanian law and you agree with the exclusive jurisdiction of Romanian courts of law.

16. CONTACTING THE CUSTOMER SUPPORT DEPARTMENT

16.1. If you need help, you may contact the Customer Support Department, by calling 021 301 33 03 (normal rates apply), Monday to Friday, between 8am and 6pm.

Alternatively, you may contact the Contracting Authority.

16.2. An automated telephone service for checking the Available Balance and blocking lost or stolen Cards is available to you 24/7, by calling the number mentioned in paragraph 16.1 above.

16.3. Reporting lost or stolen Cards is also available on MyEdenred.

This Card is issued by PrePay Technologies Ltd., member of the Edenred Group, under Mastercard® International license. The Edenred Social for hot meals programme is managed by Edenred Romania SRL, the issuer of electronic social vouchers for hot meals. The Card is valid only in Romania, within the network of partner units who accept it for payment. The use of the card for any purpose other than that for which it was issued is strictly prohibited. Mastercard and all the elements of the Mastercard brand are registered trademarks of Mastercard International Incorporated.
